Acceptance of these terms

These terms cover the First Gear website (firstgear.run), operated by Rubber Bands LLC. The app is licensed under Apple's standard end-user license agreement, and App Store purchases are subject to Apple's applicable purchase terms. These website terms do not replace those agreements or your mandatory consumer rights.

Using the app and this website

First Gear is intended for adults who want run/walk exercise guidance. You must be able to form a binding agreement to use the app, and you are responsible for the Apple Account and devices you use to access it.

You agree not to misuse the website or the app: no attempting to disrupt the service, reverse engineer the app beyond what the law allows, or use either in a way that could harm First Gear or other users.

Subscriptions, trials, and cancellation

When First Gear offers a free first session, you can start that session without a subscription. Every session after it needs one.

The advertised seven-day trial is for eligible subscribers. Eligibility, available plans, the price in your region, and the terms of an offer are shown in the App Store before you confirm a purchase.

A trial converts to the paid plan you select, and subscriptions renew automatically, unless canceled. Apple bills your Apple Account. To avoid a renewal charge, cancel through Apple subscription settings before the renewal deadline shown by Apple. For a free or discounted trial, Apple advises canceling at least 24 hours before it ends.

Deleting First Gear does not cancel a subscription. Apple provides subscription management and refund-request tools; refund eligibility is governed by the applicable purchase terms and consumer law. We do not process your payment directly or receive your payment-card details.

Exercise guidance and its limits

First Gear provides general exercise coaching, not medical advice, diagnosis, treatment, or emergency monitoring. Its estimated heart-rate ranges, talk-test prompts, scores, and stage changes do not establish that exercise is safe for you or that you are ready to increase its duration or intensity. The app does not guarantee an improvement in fitness or prevention of injury.

Ask a qualified healthcare professional about starting or changing exercise if you have a heart condition, take medication that affects heart rate, have an injury, or are unsure what is appropriate for you. The app's setup answers and alternative coaching mode are not medical clearance and do not replace an individualized plan.

You can slow down or stop at any time. Do not wait for a warning from the app if you feel unwell. Stop exercising and seek medical attention for symptoms such as chest pain, dizziness, or unusual shortness of breath. For a suspected emergency, contact local emergency services.

The guides provide general information about research and exercise. Research about groups of runners or walkers does not establish what First Gear will do for an individual, and the guides are not a personalized training or treatment plan.

Intellectual property

The First Gear name, the website, the app, and their content, including text, coaching audio, and design, belong to Rubber Bands LLC or its licensors and are protected by copyright and other laws. You may use the app and website for your own personal, non-commercial use, and you may not copy, modify, distribute, or create derivative works from them without permission, except where applicable law allows it.

Service limitations and consumer rights

We cannot promise uninterrupted or error-free service. Heart-rate sensors, GPS, weather data, and software can be inaccurate, delayed, or unavailable. Coaching prompts may not arrive when expected, and a displayed range or score is not a medical measurement.

To the extent permitted by applicable law, the website and app are provided as is and as available. Nothing in these terms removes mandatory consumer rights or excludes a guarantee or remedy that cannot lawfully be excluded.

Limitation of liability

To the extent permitted by applicable law, Rubber Bands LLC excludes liability for indirect, incidental, or consequential losses arising from use of the website or app. This does not exclude or limit liability that cannot lawfully be excluded or limited, and does not remove your mandatory consumer rights.

Changes to these terms

We may update these terms as First Gear develops. We will update the date above and provide any notice, choice, or consent process required by applicable law.
