Acceptance of these terms

These terms are an agreement between you and Rubber Bands LLC, the company that operates First Gear. They govern your use of the First Gear website (firstgear.run) and, once available, the First Gear app for iPhone and Apple Watch. By using either, you agree to these terms. If you do not agree, please do not use the website or the app.

Using the app and this website

First Gear is intended for adults who want a heart-rate-led walk-to-run coaching program. You must be able to form a binding agreement to use the app, and you are responsible for the Apple ID and devices you use to access it.

You agree not to misuse the website or the app: no attempting to disrupt the service, reverse engineer the app beyond what the law allows, or use either in a way that could harm First Gear or other users.

Subscriptions, free trial, and billing

First Gear is free to use until you have completed a week of walks, after which continued access requires a paid subscription, billed monthly or annually as described on the pricing page.

All subscriptions are sold and billed through Apple's App Store, using your Apple ID. Apple handles payment, renewal, cancellation, and refunds under its own terms; we do not process payments directly and do not have access to your payment details. To cancel or request a refund, use your Apple subscription settings or contact Apple support.

Health and safety: not medical advice

First Gear provides coaching guidance, not medical monitoring or medical advice. The heart-rate ceilings, the talk test, and the pacing decisions the app makes are designed to keep effort easy and progression gradual, but they are not a substitute for professional medical judgment.

Talk to a doctor before starting First Gear, or any new exercise program, if you have a heart condition, take medication that affects your heart rate (including beta blockers), or are otherwise unsure whether running or brisk walking is safe for you.

Stop a session and seek medical attention if you feel chest pain, dizziness, unusual shortness of breath, or otherwise feel unwell, regardless of what the app or the coach is telling you to do.

Intellectual property

The First Gear name, the website, the app, and their content, including text, coaching audio, and design, belong to Rubber Bands LLC or its licensors and are protected by copyright and other laws. You may use the app and website for your own personal, non-commercial use, and you may not copy, modify, distribute, or create derivative works from them without permission.

Disclaimer of warranties

The website and the app are provided as is and as available, without warranties of any kind, whether express or implied, including any warranty that they will be uninterrupted, error-free, or fit for a particular purpose. Heart-rate sensors, GPS, and other device hardware can be inaccurate; First Gear's coaching is only as good as the data your device provides.

Limitation of liability

To the fullest extent permitted by law, Rubber Bands LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the website or the app, including any injury that occurs during exercise. Nothing in these terms limits liability where the law does not allow it to be limited.

Changes to these terms

We may update these terms as the app and website develop. We will update the date above when we do, and continuing to use the website or the app after a change means you accept the updated terms.
